Asaduddin Owaisi Moves Supreme Court Challenging SIR Of Electoral Rolls

Owaisi's SIR petition was mentioned today before a CJI Surya Kant led bench seeking listing along with similar matters pending before Supreme Court.
AIMIM chief Asaduddin Owaisi has moved the Supreme Court challenging the Special Intensive Revision (SIR) of electoral rolls.
Advocate Nizam Pasha mentioned the petition before Chief Justice of India Surya Kant, seeking its listing alongside similar petitions scheduled to be heard on Thursday.
"The petition challenges the manner in which SIR is conducted..similar matters are coming up tomorrow..this may be listed as well," Pasha told the bench also comprising Justice Joymalya Bagchi.
CJI Surya Kant said he would check and list the petition with the connected cases.
Notably, Opposition leaders led by Rahul Gandhi have also moved a petition before Supreme Court alleging that the Chief Election Commissioner exercised the "collective powers" of the Election Commission of India on his own during the Special Intensive Revision (SIR) of electoral rolls, and have asked the Court to call for the Commission's files, minutes and notings to test whether its decisions were lawfully taken.
The writ petition, filed under Article 32 of the Constitution by Gandhi, Leader of the Opposition in the Lok Sabha, and Mallikarjun Kharge, Leader of the Opposition in the Rajya Sabha, along with other party leaders and Members of Parliament, also questions the modification of the statutory Form 6, the design and operation of the ECINET and ERONET electoral-roll databases, and the "large-scale exclusion of electors without adequate notice, hearing or an effective mechanism for restoration."
In a related development, the Supreme Court on Monday clarified that it has neither approved nor disapproved the modified Form 6 (used for inclusion of their names in electoral rolls) used by the Election Commission of India (ECI) during the Special Intensive Revision (SIR) of electoral rolls, stating that the Court had not adjudicated upon the modified form.
Court made the clarification after a petitioner pointed out that the Supreme Court had earlier stated that the modified Form 6 had not been approved by it, while the Election Commission had claimed that the declaration attached to the form had been upheld by the Court.
In May this year, Supreme Court upheld the Election Commission of India’s (ECI) Special Intensive Revision (SIR) of electoral rolls in Bihar. A CJI Surya Kant led bench, in its verdict said SIR is not in conflict with the Representation of the People Act, 1950 and the Rules framed thereunder. "The impugned SIR does not supplant the Representation of the People Act and the Rules. Rather, it breathes life into the constitutional mandate under Article 324 within the precise statutory contours provided by Section 21(3). Therefore, it cannot be said that the Commission has acted in excess of its statutory powers," the CJI read out in court.
Bench: CJI Kant, Justice Bagchi
